Calculating and Modifying Child Support in California

Child support is geared towards providing the essentials for a child, including child care, education, food, housing, health care, travel costs, and costs for other expenses, such as extracurricular activities. California courts can order one or both parents to pay a particular amount each month based on statewide guidelines via a child support order, where the determinations are largely based on parents' income levels (as indicated on income and expense declarations) and how much time they physically spend with the child.

The judge will focus on “net disposable income” in determining income levels; meaning income after taxes, after working in any dues (such as health premiums), spousal support and/or costs from children from previous relationships. Courts also factor in benefits, stocks, and any other income, such as rental property income. Once these numbers are determined, the amount is calculated based on a formula that incorporates the high earner's net monthly disposable income, the total net monthly disposable income of both parents, and the percentage of time the high earner spends with the child in the role of primary caretaker.

Of course, courts also have the discretion to diverge from this calculation in the presence of certain circumstances. For example, if the calculation would exceed the needs of the child. Courts also have the ability to enter a temporary order for the payment of support (while any relevant proceedings are pending), as well as expedited support orders.
